Pawatech Digital Systems (PDS) Terms and Conditions
These Terms and Conditions govern the use of Pawatech Digital Systems (PDS) websites, platforms, and services relating to the sale and distribution of technology products. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you should not use our platforms or engage in transactions with us. These Terms are legally binding under the laws of Kenya.
1. Services Covered
PDS operates an e-commerce platform (“PDS Shopping”) specializing in technology products including but not limited to computers, mobile devices, accessories, software, and related IT products. Additional technology-related products or services may be introduced from time to time.
2. Eligibility
To use our services, you must be at least eighteen (18) years old or the age of majority in your jurisdiction. Minors may only use our services under the supervision and with the consent of a parent or guardian.
3. Accounts
Some services may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. Misuse, fraud, or unauthorized access may result in suspension of your account and potential legal action.
4. Orders and Payments
- Orders placed through PDS platforms are binding once confirmed and paid.
- All payments must be made in Kenyan Shillings unless otherwise specified.
- Accepted payment methods include M-Pesa, debit/credit cards, bank transfers, and other approved gateways.
- PDS reserves the right to reject or cancel any order suspected of fraud, misrepresentation, or violation of these Terms.
5. Delivery and Risk of Loss
- Delivery terms are provided on our Shipping Details page.
- Risk of loss passes to the customer upon confirmed delivery.
- Customers are entitled to remedies in accordance with our Refund and Returns Policy where products are defective, counterfeit, or not as described.
- Voluntary returns for “change of mind” are subject to conditions stated at purchase.
6. Prohibited Conduct
- Provide false or misleading information.
- Engage in fraudulent transactions.
- Attempt to sell or distribute counterfeit technology products.
- Misuse the platform or post illegal, defamatory, or offensive material.
All users must comply with applicable Kenyan laws, including consumer protection and data protection legislation.
7. Intellectual Property
All content, trademarks, logos, software, and designs available on PDS platforms are the intellectual property of PDS or its licensors. Users may not reproduce, distribute, or exploit this content without prior written consent.
8. Data Protection
PDS collects and processes customer data in compliance with the Data Protection Act, 2019. Personal information is used only for service delivery, payment processing, communication, and compliance with legal obligations. Customers may request access, correction, or deletion of their personal data, subject to legal requirements.
9. Product Authenticity and Anti-Counterfeit
The sale or listing of counterfeit or prohibited technology products is strictly forbidden. PDS complies with the Anti-Counterfeit Act and works closely with enforcement authorities. Any offender will be reported and prosecuted.
10. Liability
- PDS strives to provide accurate product information and reliable services but does not guarantee error-free content or uninterrupted access.
- PDS is not liable for indirect or consequential damages, including loss of income, data, or business opportunities.
- Liability for defective products is limited to remedies provided under Kenyan law and PDS’s Refund and Returns Policy.
11. Fraud Prevention
Fraudulent activity — including use of stolen payment methods, false identities, or fraudulent returns — will be investigated and reported to law enforcement under the Penal Code. PDS reserves the right to suspend accounts and recover damages.
12. Dispute Resolution
Customers are encouraged to first contact PDS customer support in case of disputes. If unresolved, disputes may be escalated to relevant consumer protection agencies, including the Competition Authority of Kenya. Parties may also pursue arbitration or litigation under Kenyan law. Jurisdiction lies with Kenyan courts.
13. Force Majeure
PDS is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, government actions, or internet outages.
14. Updates to Terms
PDS may update these Terms from time to time for compliance or operational reasons. Continued use of our platforms constitutes acceptance of the revised Terms. Customers will be notified of material changes via email or website notices.
